Terms and Conditions of Use

These Terms and Conditions supersede all previous representations, understandings or agreements and shall prevail notwithstanding any variance with terms and conditions of any order submitted.

1.0 INTERPRETATION
1.1 The “Website” refers to BritishExam.com as maintained by the Company.
1.2 The “Content” refers to all content of the Website, including all the text, graphics, images, logos, software and available downloads.
1.3 The “Company” is ABC Logix Ltd , 15 Crutchfield Lane, Walton on Thames, KT12 2QY.
1.4 The “Customer” is the individual or firm ordering or buying goods from the Company and whose Order for the Goods is accepted by the Company.
1.5 The “User” is an individual browsing the Website or making use of its Goods or Services or acting as a Customer.
1.6 The “Order” is the act of the Customer signifying their intention to enter into a legally binding agreement with the Company as accepted by the Company.
1.7 The “Sale” means the sale of the Goods or Services or whose Order for the Goods or Services is accepted by the Company.
1.8 “Subscription” means a stated period for which access to the Goods or Services from the Website will be granted.
1.9 The “Price” means the amount of money payable in return for the supply and Sale of Goods and Services.

2.1 These Terms and Conditions apply to all Customers accessing Goods or Services from this Website.
2.2 ABC Logix Ltd reserves the right to:
i. Alter the content or structure of this Website at any time and without notice.
ii. Alter the Terms and Conditions with 7 days notice following publication of a notice of the relevant alteration on this Website.
2.3 The Customer acknowledges that:
i. Notice of any alteration in the Terms and Conditions in accordance with 2.2(i) is adequate and sufficient.
ii. It is the responsibility of the Customer to check this website regularly for any variation or change in the Terms and Conditions
2.4 No order submitted by the Customer shall be deemed to be accepted by the Company unless, until and only when confirmed in writing or written electronic communication by an authorised representative of ABC Logix Ltd.

3.0 ORDERS
3.1 No Order submitted by the Customer shall be deemed to be accepted by the Company unless and until confirmed in writing by the Company’s authorised representative.

4.0 SUBSCRIPTION
4.1 The right to use any product or service offered by ABC Logix Ltd is personal to you and is not transferable to any other person or entity.
4.2 You shall provide ABC Logix Ltd with accurate, complete and updated information provided by you at the time of subscription.
4.3 You are responsible for any charges associated to connecting to the BritishExam.com Site, including but not limited to, any telephone line charges or any Internet access provider charges. You shall provide ABC Logix Ltd with accurate, complete and updated information as to your name and e-mail address and credit card account information provided by you at registration. Failure to do so shall constitute a breach of this Agreement.
4.4 You shall be responsible for obtaining and maintaining all electronic communications, computer hardware and other equipment needed for access to and use of the BritishExam.com Site and all charges related thereto.
4.5 You authorize ABC Logix Ltd to charge to the credit card account designated during the registration process the current fees and charges for each term according to the subscription plan chosen by you.

5.0 PRICING
5.1 Price for the Goods and Services are those ruling at the time of Subscription or Sale of the Goods and ABC Logix Ltd reserves the right to amend its quoted prices at any time prior to the point of Sale.
5.2 The Price shall be quoted and payable in Sterling.

6.0 TERMS OF PAYMENT
6.1 Payment must be made in full at the point of Order. The price will be as specified on the Website at the time or Order.
6.2 In the event of delay or refusal of payment ABC Logix Ltd will immediately suspend any order(s) unless there is good reason, and such good reason for non – payment is made known to and accepted by the Company in writing or electronic written communication by an authorized representative of the Company.
6.3 Where payment in full is not made access to the Goods or Services of the Website will be suspended until payment in full in cleared funds is made by the Customer.

7.0 CANCELLATION
7.1 ABC Logix Ltd shall have the right to immediately terminate this Agreement with respect to any User which ABC Logix Ltd, in its sole discretion, considers to be unacceptable, or in the event of any breach by you of this Agreement. In the event that your account is terminated or canceled, no refund of any fees, including monthly membership fee, will be granted.
7.2 You may cancel your Subscription by logging onto the website and clicking the button/link appropriate for that purpose or in writing or written electronic communication to the Customer Services department whose contact details are given in the relevant area of the website.  Payments for Subscriptions are made in full in advance and no refunds will be given for cancellation of the Subscription by the User.
7.3 Cancellation is not assured unless such acknowledgement is received by the Customer.

8.0 COMPLAINTS AND REFUND POLICY
8.1 In the unlikely event that the Customer is not satisfied with any aspect of Services provided by the Company, notification as such may be communicated by written or written electronic communication to the Company at the address given on the Website.
8.2 The Company will attempt to respond to any complaint within 7 days of receipt.
8.3 The aim of the Company is to resolve any issue by mutual agreement within a reasonable time scale.
8.4 In the unlikely event of a loss in services from the BritishExam.com Website no refunds will be issued except where there is a problem with the BritishExam.com Website that cannot be fixed within 5 working days.
8.5 Refunds will be made at the discretion of ABC Logix Ltd. Your Statutory Rights are not affected.

9.0 PRIVACY
9.1 All communication between the Customer and the Company shall be treated as confidential and the Company shall ensure that it is protected to the highest level.
9.2 Registration details and information relating to the identification of the Customer will be kept in the strictest confidence by the Company, and will not be used for any purpose besides that required for the deliverance of Services by the Company as agreed by the Customer.

10.0 YOUR ACCOUNT
10.1 Immediate Access to your account will be given after your payment is confirmed and you will be able to login to the Website with your username and password.
10.2 You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password.
10.3 In the event of loss or misrecollection of your password you may be elligible for reissue of a new password through our technical support area. Reissue of passwords will be made at the sole discretion of ABC Logix Ltd.
10.4 Your Membership account is not transferable, nor is one exam specialty transferable to another.
10.5 If you access BritishExam.com services from a public computer you must ensure that you log-out from and terminate your session with BritishExam.com before leaving. No more than one active session will be available to the User at any time.

11.0 ELECTRONIC COMMUNICATIONS
11.1 When you access BritishExam.com or communicate electronically with us you consent to receive further communication from us electronically.

13.0 COPYRIGHT
13.1 All content of BritishExam.com, including logos, text, graphics and images, downloads and software is the property of ABC Logix Ltd and is protected by UK and international copyright law, unless stated otherwise. The compilation of all content on BritishExam.com is the exclusive property of ABC Logix Ltd and is protected by UK and international copyright law.
13.2 The User must not modify, copy, reproduce, republish, frame, upload to a third party’s computer equipment, transmit or distribute in any way the whole or any part of the Content except and only with expressed consent from the Company.

14.0 DISCLAIMER AND LIMITATION OF LIABILITY
14.1 ABC Logix Ltd attempts to ensure that all descriptions of products and services on this Website are as accurate as possible. However, ABC Logix Ltd does not accept responsibility for and excludes all liability in connection with the viewing of this Website, use of information contained therein and downloading of any material including, but not limited to, errors, inaccuracies, omissions, misleading or defamatory statements.

15.1 The Company reserves the right to cancel, vary or suspend the operation of the contract of sale if events occur which are in the nature of force majeure; and the Company shall not be held liable for any breach of contract resulting from such an event.

16.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only be the English Courts.

17.0 STATUTORY RIGHTS
17.1 Your statutory rights are not affected.
